Terms of Service

Last updated October 14, 2026

These terms are an agreement between you and Branded Monthly LLC (“we”, “us”), the Florida company that runs Sudsy Social. By creating an account or using Sudsy Social, you agree to them and to our Privacy Policy. If you don’t agree, please don’t use the service.

In these terms, “you” means the business owner who signs up (a “member”) and the business they sign up for. “Your clients” means the people your business cleans for, and people who call, text or write to your business or ask it for a price.

1. What Sudsy Social does

Sudsy Social is the front office for a house-cleaning business, in English and Spanish. It catches the calls where jobs begin, answers new leads, gives prices from your own price list, helps you book them, and takes care of your clients with confirmations, reminders, check-ins and review requests, all in your business’s name. Results shows what happened and why.

Social media posting is not part of Sudsy Social today. We don’t make, schedule or publish posts for you, and no package includes them. If we offer posting again later, it will be a separate add-on with its own terms.

Calls always ring your phone first. No AI ever answers or speaks on a call.

Features may change, be added or be removed as Sudsy Social grows.

2. Your account

  • You must be at least 18 and use Sudsy Social for a real business you own or are allowed to represent.
  • Give us accurate information, and keep your password private. You’re responsible for what happens in your account, including what anyone you give a login to does in it.
  • Tell us right away through our contact form if you think someone else got into your account.

You also agree to five things (when sign-up asks you to confirm them, we keep your answers with the time and their version): you’ll only text your own clients and people who contacted your business; you won’t upload bought, rented or scraped lists; your prices and service area are accurate; your business is real and lawful; and you won’t use Sudsy to text anyone without their consent.

3. Your business and its texting registration

You are responsible for your own business: that it is set up, licensed and insured as your state and city require, that it pays its taxes, and that what you tell your clients and the phone companies is true.

To text from your Sudsy number, the phone companies require your business to be registered. You give us its facts: the legal name, EIN and address exactly as on your IRS letter, or, if you don’t have an EIN, your own name, home address and mobile number as a sole proprietor. You photograph your IRS letter, our AI reads it, you check every line against the photo, and we compare it with your state’s public business records (Florida’s Sunbiz today). You promise these facts are true, complete and your own.

You authorize us to file the registration for you, in your business’s name, in your own Twilio sub-account: toll-free verification for a toll-free number, or a brand and campaign with The Campaign Registry for a local number. You never submit anything yourself. A person at Sudsy may check your details before we file, and we may decline to turn texting on for a business we can’t verify.

The phone companies decide whether to approve your business and how long it takes; we can’t guarantee approval or timing. If they turn it down for something on our side (our web page, the opt-in or the sample messages), we fix it and file again. If it’s about your facts, we ask you for one clear fix.

If the facts you gave are wrong or not yours, we may stop texting for your business.

4. Packages, trial and billing

  • Packages: Essentials is $149 a month and Autopilot is $299 a month, or a year for the price of 10 months ($1,490 and $2,990). What each package includes is shown on our pricing page and in Plan & billing. Plans are billed in advance and renew automatically until you cancel.
  • Founding members pay $99 a month for Essentials and $199 for Autopilot. A founding price stays yours while your plan stays active without a break.
  • Essentials comes with a toll-free number. A local number is $15 a month on Essentials ($150 a year); Autopilot includes one. Autopilot and the local number can be chosen once texting is live for your business.
  • Free trial (Essentials): 14 days, counted from the day you sign up. It needs a card, and turns into a paid plan at the end unless you cancel. If you turned on texting and the phone companies are still reviewing your business when the 14 days end: Your trial is extended until texting has been live for 14 days. In all, the trial lasts at most 45 days from sign-up. The trial includes 100 texts, which are never billed.
  • Before any charge: we email you at least 3 days before your trial ends, and again on its last day, with the date, the amount and the card. Cancel in Plan & billing before then and you pay nothing.
  • Cancel anytime in Plan & billing. Your plan stays active until the end of the period you paid for. We don’t give refunds for partial periods.
  • Price changes: we give you 30 days’ notice.
  • Taxes are added where the law requires them.
  • If a payment fails, we try again and remind you, with a link to update your card. Nothing stops for 14 days; if it still fails after that, your plan ends (see “Your Sudsy number” for what happens to your line).
  • Payments are handled by Stripe, under its terms.

5. The texting setup

Turning on automatic texting costs $49 once (the texting setup). It’s charged to your card when you tap “Turn on automatic texting” in Settings → Phone, never at sign-up, and it’s the same on every package and for founding members.

It pays for us preparing, checking and filing your business’s registration with the phone companies, and up to 2 resubmissions if they ask for changes.

It’s credited to your first paid month: it comes off your first payment by itself (or your next payment, if you’re already paying).

The texting setup is non-refundable, including if the phone companies don’t approve your business. Before we charge it, you tick a box that says: “I understand the $49 texting setup is non-refundable, including if the phone companies don’t approve my business.” We keep those exact words, their version and the time.

6. Texts, monthly allowance and text packs

Each package includes texts every month: 500 on Essentials and 1,500 on Autopilot. Unused texts don’t carry over to the next month.

Texts are counted the way phone companies count them: a long text, or one with some accented letters or emoji, counts as 2 or more. The app shows you when a text will count as more than one.

Past your monthly texts, texts come from text packs: 500 texts for $25, charged to your saved card when bought, good for 90 days from purchase. Your monthly texts are used first, then the pack that expires first. Texts left in a pack when it expires are lost, and packs are non-refundable.

  • The automatic pack is on unless you turn it off: if you’re out of texts and a reply, confirmation or reminder needs to go, we buy one pack so it isn’t held up, and email you. With it off, that text waits for you, the lead gets one holding message, and you get an urgent alert.
  • Campaigns and other offers stop when you’re out of texts. The answers to STOP, START and HELP always go.
  • Auto-recharge is off unless you turn it on: it adds a pack when fewer than 50 texts are left, up to your own monthly limit ($100 unless you change it).
  • Past $100 of packs in one month, a pack you buy yourself asks you to confirm first. The automatic pack still buys, so no client is left without an answer.
  • We email you when 80% of the month’s texts are used, and each time a pack is bought for you.
  • During the free trial, texts are never billed and no pack is bought.

7. Rules for using Sudsy Social

You agree to follow the law. In particular:

  • Real relationships only: contact only people who booked with you, asked you for a price, called or texted your business, or reached you through your referral link. Never upload or message bought, rented, borrowed or scraped lists.
  • Reviews: never write fake reviews, buy reviews, or offer anything in exchange for a review. The FTC’s rule on consumer reviews (16 CFR Part 465) bans these practices, and Google doesn’t allow rewards for reviews at all. Sudsy asks every client the same neutral way, not only the happy ones.
  • Your claims: only offer deals you honor, and only describe your business (licensed, insured, background-checked) truthfully.
  • Respect others: don’t send anything illegal, false, hateful, or that uses someone else’s name, photos or brand without permission.
  • Don’t misuse the service: no hacking, scraping, overloading it, getting around limits, or using it to send spam.

To protect your clients and your number, we limit how many texts a business sends a day (lower in its first 30 days; the rest wait for the next morning), and we pause a business’s texting by ourselves when opt-outs, failed texts, carrier filtering or complaints pass our safety limits. Only we turn it back on, and we tell you why. We may also pause offers or suspend an account when these rules are broken.

8. Consent and messages to your clients

Texts and emails Sudsy Social sends for you go out in your business’s name. You are responsible for having each person’s permission, and for every message you send or approve. Sudsy gives you the tools to do this right, and you agree not to work around them:

  • No text without a yes: Sudsy texts a person only when they ticked the texting box on your page or form, or texted your business first. Clients you import (from a file, your phone, a calendar or a booking app) get no texts until they agree themselves; until then, service messages go by email.
  • One permission text: after a missed call from a mobile number Sudsy doesn’t know, your business may send one text that only asks permission to reply. Nothing else goes until they say yes or ask for a cleaning. No answer means no more texts, and you get “Call them back”.
  • Quiet hours: automated texts go only between 8 am and 8 pm in the client’s time zone.
  • Offers: a promotional text needs the client’s own, separate yes to offers by text, which you can’t give for them; at most 2 promotions a month go to each client, and at most 3 on one subject in 24 hours.
  • STOP and HELP always work, in English and Spanish, and so do plain words like “stop texting me”. A STOP ends texts from your business to that person at once, including texts already waiting to go.
  • Every first text and every offer names your business and says how to stop.
  • Emails with an offer have an unsubscribe link that works at once, say they’re promotional, and show your business’s mailing address; they wait until you add one.
  • Where Sudsy offers to write a text for you to send from your own phone in one tap (before texting is live for your business), those texts are yours: the same consent rules apply, and Sudsy never fills in an offer for a client who hasn’t said yes to offers.

You also agree to follow the law, including the Telephone Consumer Protection Act, Florida’s Telephone Solicitation Act, CAN-SPAM and your own state’s rules, and Twilio’s Acceptable Use Policy and Messaging Policy. Where Florida’s rules are stricter, Sudsy applies them to every business in every state.

For people who get these texts:

  • What they are for: replies to quote requests and questions, booking and appointment messages (confirmations and reminders), payment details after a clean, review requests and check-ins after a clean, customer care and, only if you agreed to them separately, offers (at most 2 promotions a month).
  • Message frequency varies. Message and data rates may apply.
  • You agree to get texts by ticking the texting box on the business’s form or by texting the business first. Agreeing is not a condition of any purchase.
  • Reply STOP at any time to opt out, START to opt back in, and HELP for help. For support, contact the business or contact us.
  • Carriers are not liable for delayed or undelivered messages.
  • Mobile numbers and text opt-in consent are never sold or shared with third parties for their marketing. See the Privacy Policy.

9. Your Sudsy number

When you set up calls, we get a phone number for your business: toll-free on Essentials, local on Autopilot or with the local-number add-on. It doesn’t change while you keep your plan.

Your number, its texting registration and its usage are kept in your own Twilio sub-account, which we open and manage for you under Sudsy’s Twilio account, so a problem with another business’s number never affects yours. You don’t need your own Twilio account.

Your number belongs to your business. If you leave Sudsy Social, we transfer it to your new phone company at no charge: ask us through Account → Help before it’s released. While a transfer is pending, we never release your number or give it to anyone else. The texting registration we filed for your business doesn’t move with the number; the new phone company registers it again.

A number that’s set up but never tested within 7 days is let go, with a heads-up the day before, unless calls are arriving on it.

When your plan ends, your line keeps taking messages for 30 days (7 days after a free trial): callers hear your business’s name and the recording notice, each voicemail is sent to you by email and text, and callers get no texts. While forwarded calls keep arriving, we remind you to undo call forwarding. Before the number is released we send you a final notice; if calls are still arriving, we keep it once more for the same length of time, then release it. A released number can go to someone else and can’t be recovered.

You set up call forwarding with your phone company, pay any charges for it, and undo it when you leave.

10. Calls and voicemail

Calls to your Sudsy number ring your phone first, and a call you answer is never recorded. A call you miss hears a short recorded greeting in your business’s name (text-to-speech or your own voice) that says, in English and Spanish, that messages may be recorded and transcribed, and the caller can leave a voicemail. You can’t remove that notice.

We turn voicemails into text so you can read them and so Sudsy can tell a request for a cleaning from a sales call. The recording is kept for 90 days, then deleted; the words stay with the lead. Calls from numbers you mark Personal are never transcribed.

11. Emails to your clients

Emails Sudsy sends for you come from your business’s name alone, at Sudsy’s sending address, and don’t advertise Sudsy. When a client replies, the reply reaches you: at your own email, or, once replies through Sudsy are on for your business, in the same conversation in Sudsy with a copy to your business email; there, a reply asking to unsubscribe stops your emails to that person at once.

You promise the mailing address you give us is one where your business gets mail (a P.O. box or mailbox service is fine).

An address that bounces isn’t emailed again by Sudsy; a spam complaint stops emails from your business to that person.

12. The AI assistant

What it does: it reads new leads’ messages and drafts replies in your business’s name, asks the questions needed for a price in a fixed order, sends a price our code computed from your own price list, offers only times that are really open, and drafts confirmations, reminders, check-ins, review requests and replies to reviews. It can translate between you and a client, and rewrite your own message when you ask.

What it never does: invent prices, offers, discounts, refunds or free re-cleans; promise a time that isn’t open; give legal or medical advice; or claim to be a person. Our code checks every draft before it can go, and holds back one that breaks these rules.

What it hands to you: complaints, emergencies, unusual jobs (like move-outs and post-construction), anything it isn’t sure about, and every new client’s first booking.

You start in practice mode: for your first 14 days and 20 leads (whichever comes later), everything it writes waits for your OK. After that you choose, task by task, whether it waits for you or sends by itself (automatic prices and booking for standard jobs are on Autopilot only).

It signs with your business’s name, says it’s a virtual assistant whenever asked, and adds “(AI assistant)” to its first text to people in California, and to everyone if you turn on “Introduce the assistant”.

It can still make mistakes. You’re responsible for the prices, policies and details you give it, and for drafts you approve. Report a wrong message with one tap; we look at every report.

Your clients’ information is never used to train AI models.

13. Your content

You keep ownership of what you bring to Sudsy Social: your logo, photos, words, price list, reviews, client list and other information (“your content”). You give us permission to store, copy, format and show your content only as needed to run the service for you, such as answering your leads and showing your My page. This permission ends when you delete your content or your account, except for copies in short-term backups and the records described in the Privacy Policy.

You promise that you have the right to use your content, and that the people in your photos agreed to them being shared.

14. Your clients’ information

Your clients’ information belongs to your business. We process it only to provide the service to you. We never sell it, never use it for our own marketing, and never use it to train AI models. Other businesses on Sudsy never see it; see “How we match people without sharing them” in the Privacy Policy.

Consent and opt-out records, and the permanent record of messages, calls, bookings and charges, are kept for 5 years, even after you delete a client or your account, so permission can be shown and opt-outs are never undone.

15. Our software

The app, its designs, message templates, wording and guides belong to us. You may use the messages Sudsy writes for your business, during your membership and after it ends. You may not resell our templates, copy the app, or use it to make a competing product.

16. Advice and results

Our tips, checklists and calculators are general information, not legal, tax or financial advice.

Numbers in Results are our best count, from your own calls, leads and bookings recorded in Sudsy Social and in the apps you connect. We don’t promise any number of leads, bookings, reviews or income.

We don’t run ads for you. If you buy ads, you pay the ad platform directly and its terms apply.

17. Other services

Sudsy Social works with services we don’t control: Twilio (calls and texts), Stripe (payments), Google Calendar, Google Business Profile, Jobber and Housecall Pro. When you connect one, you let us read your account (and, where you choose, write to it) as each feature describes. Their own terms and policies apply, they can change or stop their features, and we aren’t responsible for them. You can disconnect at any time.

If you connected Facebook or Instagram before posting was paused, nothing is published through it. You can disconnect it at any time.

18. Feedback

If you send us ideas or feedback, we may use them to improve Sudsy Social without owing you anything. Thank you: it really helps.

19. Canceling, leaving and your data

You can cancel any time in Plan & billing. Billing stops at the end of the period you paid for.

After your plan ends, you have 30 days to download your data (Account → Your data). We email you when that starts and 7 days before the end, then delete your account. Coming back before then stops it.

You can also delete your account yourself in Account → Delete my account. Download your data first if you want a copy; deleting can’t be undone.

What we keep after a deletion: consent and opt-out records, and the permanent record of messages, calls, bookings, charges and Terms acceptances, for 5 years; billing records as long as tax law requires. See the Privacy Policy.

We may suspend or close an account that breaks these terms or puts others at risk, with a written reason, or stop offering the service with reasonable notice.

20. No warranty

We work hard to keep Sudsy Social running well, but it’s provided “as is” and “as available”, without warranties of any kind, to the extent the law allows. We don’t promise it will always be available, error-free or fit for a particular purpose, or that the phone companies will deliver every text.

21. Limit of liability

To the extent the law allows, we aren’t liable for indirect, incidental, special or consequential losses, such as lost profits, lost clients or lost data. Our total liability for any claim related to Sudsy Social is limited to the greater of what you paid us in the 12 months before the claim, or $50.

22. Your responsibility to us

If someone makes a claim against us because of your content, the facts you gave for your registration, the messages you send or approve, or your breaking these terms or the law, you agree to cover our reasonable costs and losses from it.

23. Law and disputes

These terms are governed by the laws of the State of Florida and the United States, without regard to conflict-of-law rules. If we have a disagreement, let’s try to sort it out first: contact us and we’ll work on it in good faith. If we can’t, the state and federal courts located in Florida will decide it, and we both agree to their jurisdiction. Either of us may use small claims court where it applies.

24. Agreeing electronically

Ticking a box to agree to these terms, or to the texting setup, is your electronic signature, and has the same effect as signing on paper. We send notices by email or in the app.

25. Changes to these terms

We may update these terms as Sudsy Social grows. We’ll post the new version here with a new date and tell members by email or in the app before important changes take effect. If you keep using Sudsy Social after that, the new terms apply.

26. The rest

If part of these terms can’t be enforced, the rest still applies. Not enforcing a part isn’t giving up the right to. You can’t transfer your account or these terms to someone else without our OK; we may transfer them as part of a business change. These terms and the Privacy Policy are the whole agreement about Sudsy Social.
